Kenneth Ofori-Atta Sues Police Officers Over Unlawful Home Search

Former Finance Minister Kenneth Nana Yaw Ofori-Atta has taken legal action against two senior police officers, accusing them of unlawfully invading his residence and conducting an illegal search. The lawsuit, filed at the High Court of Justice, General Jurisdiction, Accra, is directed at DSP Bismarck Boakye Ansah and Chief Inspector Mensah, also known as Sir Mensah, both stationed in Accra.

Ofori-Atta claims that on February 11, 2025, the officers, who are allegedly operatives of the National Security, forcefully entered his home at 25 Aborlebu Crescent, Labone, Accra (GL-041-2486) without a search warrant or legal justification. In response, he is seeking damages for trespass and a court injunction preventing further intrusions.

Ofori-Atta Seeks Legal Remedies for Privacy Violation

In his Statement of Claim, Ofori-Atta argues that the officers’ actions were a gross violation of his constitutional right to privacy. He is requesting the court to:

  • Declare that the officers trespassed on his property and violated his right to privacy.
  • Award general damages for trespass and aggravated damages for privacy breach.
  • Issue a perpetual injunction preventing the officers, their agents, or assigns from further invading his residence.
  • Cover the costs associated with filing the lawsuit.

The writ of summons, signed by Mrs. G. Sackey Torkornoo, mandates the defendants to respond within eight (8) days. Failure to do so may result in a judgment being entered against them in absentia.

Controversy Over Security Agencies’ Conduct in High-Profile Cases

The February 11 search at Ofori-Atta’s residence has sparked widespread public debate, with critics questioning law enforcement tactics in high-profile investigations. The lack of a search warrant has particularly raised concerns about abuses of power by security agencies.

Although the search is believed to be linked to ongoing investigations, Ofori-Atta’s lawsuit underscores the increasing scrutiny of law enforcement conduct in politically sensitive cases. The case is now before the High Court, awaiting further legal proceedings.
